2. Description of Services

SaaS Dealer, Inc provides business management tools including but not limited to: customer relationship management (CRM), quote and proposal generation, appointment scheduling, customer communication (SMS, email, voice), payment processing, job management, and marketing automation. Services are provided on a subscription basis.

3. Account Registration

To use the Services, you must create an account and provide accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring all users added to your account comply with these Terms

4. Subscription and Payment

Access to the Services requires a paid subscription. By subscribing, you agree to:

• Pay all fees associated with your selected plan
• Provide valid payment information and authorize recurring charges
• Usage-based charges (SMS, voice, email) are billed separately based on actual usage
• Subscription fees are billed monthly or annually as selected
• You may cancel your subscription at any time; access continues until the end of the current billing period
• Refunds are not provided for partial billing periods

5. Acceptable Use

You agree to use the Services only for lawful purposes and in compliance with all applicable laws. You shall NOT:

• Send unsolicited or spam messages (SMS, email, or voice)
• Violate the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or other messaging regulations
• Message individuals who have not provided opt-in consent
• Use the Services for fraudulent, deceptive, or illegal activities
• Attempt to access other users' accounts or data
• Interfere with the proper functioning of the Services
• Upload malicious content, viruses, or harmful code
• Resell, sublicense, or redistribute the Services without authorization

6. Data and Privacy

Your use of the Services is also governed by our Privacy Policy. You retain ownership of the data you input into the Services. We will not sell, share, or use your business data for purposes other than providing the Services.

You are responsible for ensuring that your collection and use of customer data through the Services complies with all applicable privacy and data protection laws.

7. Messaging Compliance

If you use SMS, email, or voice messaging features, you must comply with our Messaging Policy & SMS Terms. This includes obtaining proper consent before messaging contacts and honoring all opt-out requests. Violation of messaging compliance may result in immediate suspension of messaging capabilities.

8. Templates and Documents

We provide sample contract templates, warranty documents, and other business document templates for your convenience. These templates are provided "as-is" and do NOT constitute legal advice. You are solely responsible for reviewing, customizing, and ensuring the legal compliance of any documents generated using the Services. We recommend consulting with a licensed attorney for your specific needs.

9. Intellectual Property

The Services, including all software, designs, text, and content created by SaaS Dealer, Inc, are protected by intellectual property laws. You retain ownership of your business data and content. We retain ownership of the platform, tools, templates, and underlying technology.

We strive to maintain high availability but do not guarantee uninterrupted access to the Services. We may perform maintenance, updates, or experience outages. We will make reasonable efforts to notify you of planned maintenance in advance.

12. Termination

We may suspend or terminate your account if you violate these Terms, fail to pay fees, or engage in activities that harm the Services or other users. Upon termination, you may request an export of your data within 30 days.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Services. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Georgia, United States. Any disputes shall be resolved in the courts of Fulton County, Georgia.
